The website www.entertainmentnow.com.au (“the website“) is owned and operated by Entertainment Now Pty Ltd (“the Company“,”we“, “us“) registered in Australia. Australian Business Number (ABN): 36 067 181 969.
Entertainment Now is an advertising business and NOT an agency. The company does not receive payments, commissions or bonus payments for a person engaging or transacting the services or products of an advertiser.
A person or entity (‘supplier’) is deemed to be an advertiser (“the advertiser“) by submission of their personal and / or business details via the website with the instruction to the company to publicly display those details for commercial purposes. A fee for this service is paid to the company.
You agree to be bound by the terms and conditions listed below and any other laws or regulations which apply to copyright and other forms of Australian and international intellectual property protection laws.
Disclaimer
- Your use of the website and services is at your sole risk.
- All material on our web site is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication.
- Access to the website and service is provided on an ‘as available’ basis.
- The company reserves the right to refuse any advertiser for any reason at its sole discretion.
Advertiser Conditions
The advertiser must meet and continue to meet the following conditions with respect to their website (or the external URL link to you from www.entertainmentnow.com.au).
- Your web site must be on-line and complete. No holding pages or ‘under constructionrs’ pages are allowed.
- Your website content must be entertainment or event based.
- Your website must not contain abusive optimization techniques such as spam, third party pop-ups, hidden links or data collection techniques.
- Your website must contain unique content. No affiliate pages that mirror original content are allowed.
- Your site must contain decent and safe content. Neither adult or gambling content nor links from your site to sites with adult or gambling content are permitted.
- Your correct contact details must be clearly displayed in the public area or your website.
A breach of any one or more of these conditions will result in an immediate suspension of all listings and advertisements. In case of a breach, paid listings will be suspended until such a time as all conditions are met. A reinstatement fee of $50 is payable and once this fee is paid; the listing and or advertising will be reloaded onto the website. Any further breaches will result in listings being terminated and the advertiser will be banned from further listings on the website.

Entertainment Now reserves the right to modify, update or change any advertiser’s conditions without notice.
Indemnity
You agree to indemnify, defend and hold Entertainment Now Pty Ltd, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g. consultants and contractors) (collectively “Indemnified Person/s”) harmless from and against any and all third party claims, actions, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person/s, arising out of, related to, which may arise out of, or in connection with your use of our services and the use of the website, and/or your breach of any term of this Agreement.
The Company shall not be responsible for any acts or defaults of the advertiser or the advertiser’s employees or any other personnel provided by the advertiser.
Limitation of Liability
Entertainment Now Pty Ltd will not be liable for loss resulting from any action or decision by you in reliance on the information on the website or services, nor any interruption, delay in operation or transmission, virus, communications failure, internet access difficulties, or malfunction in equipment or software.
No Warranty
Entertainment Now Pty Ltd nor its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties make any representation or warranty that any material on the web site or services will be reliable, accurate or complete.
Entertainment Now Pty Ltd does not endorse nor recommend any commercial products, processes, or services. The views and opinions of authors and advertisers expressed on the website do not necessarily state or reflect the opinion of the company.
The company is not responsible for the content, and makes no warranty as to the accuracy of advertiser’s information. Users of the website should always use their own judgment in deciding whether to contact or engage the services of advertisers listed on the website.
Advertising Amendments & Cancellations
All monthly listings and banner advertisements may be cancelled at any time by 30 days written notice.
Any amendments to listings can be made via suppliers login admin area.
Entertainment Now offers a 60 day money back guarantee on all new listings. After that, cancellations can be made at any time 2 weeks before auto-renewal billing cycle. See FAQs for further details.
Copyright
All material on Entertainment Now is copyright. Advertisers agree that once they submit materials and information to Entertainment Now, it is copyright protected as the non-exclusive property of Entertainment Now.
You may NOT copy, use or reproduce any text, images, any multimedia files nor contact information of advertisers nor any intellectual property on our website to establish, maintain or provide your own publications, web site or other means of distribution including digital delivery.
Any person or entity who is found in breach of the Copyright Act of Australia 1968 will be prosecuted to the full extent permitted by law.
Publicity
Advertisers place listings on the Entertainment Now website for potential commercial gain. Entertainment Now maintains all rights to use and make public the advertisers listing details, communications and testimonials in any way it identifies as beneficial to promote, advertise and market the services of the company. This includes but is not limited to the use of the advertisers images, business names and logos, testimonials and branding materials in print and digital media. In the case where the company provides additional publicity for one or more advertisers, it does so of its own accord and will not charge additional fees to the advertiser unless a prior arrangement has been made.
Internet Service
The company has a reliable ISP and website uptime is 99.9% guaranteed. From time to time, the company reserves the right to schedule maintenance on the website and take it off-line. You indemnify the company from any loss or claim associated with our website being offline for any reason whatsoever.
Security from viruses and other destructive material cannot be guaranteed by the company. You use the website at your own risk.
Privacy
The personal information we collect via this website may include:

Governing Law and Jurisdiction
This Agreement takes effect, is governed by and shall be construed in all respects in accordance with the laws in force in Victoria, Australia. All parties hereto submit to the non-exclusive jurisdiction of the Courts of Victoria in respect of any matter or thing arising out of this Agreement.
